RCPD Dispute Resolution and Appeals Process

Though RCPD staff enjoys a reputation of fairness, compassion, and integrity, the possibility always exists for disagreements about disability determination, appropriateness of accommodations, or service quality. In the event a disagreement should arise, you are encouraged to make use of the following process outlined in the MSU Disability Reasonable Accommodation Policy.  

The process below is only for student accommodations determined by RCPD. Please review the MSU Disability and Reasonable Accommodation Policy or full details on this process and for information on other appeals processes (i.e. employment, visitors, etc.).

1. Request Reconsideration

Contact the RCPD Specialist to request reconsideration of a decision that was made. Be prepared to consider alternative solutions and perspectives. A reconsideration can be initiated by the student for a disability/accommodation determination or by a faculty/instructor with a concern about an accommodation determination applies to a course/program under their purview.

2. Dispute Resolution

If this discussion does not resolve the situation, student, faculty, or instructor may may pursue concerns about service quality and/or a disability/accommodation determination through Dispute Resolution with the Director/Associate Director of the RCPD. The Director/Associate Director, or their designee, gathers details of the dispute, meets individually or as a group with those involved, and ultimately seeks a resolution or provides an official office position on the disputed accommodation determination. 3.  File an Appeal with the ADA Coordinator

If you disagree with the RCPD's  Dispute Resolution determination, the decision may be appealed to the University's ADA and Section 504 Coordinator using the Incident Reporting Form or sent in writing:

Appeals of RCPD decision must be filed with the Office of the ADA Coordinator within 30 calendar days of the party’s notification of the decision. This time limitation can be extended for good cause, as determined by the ADA Coordinator.

*Appeals of employment accommodation decisions made by ELR go directly to the ADA Coordinator. RCPD's Dispute Resolution process above does not apply to employee determinations. Appeals not covered by this policy should be submitted to the ADA Coordinator.
